Exclusion of Reversal of Burden of Proof

Exclusion of the reversal of the burden of proof when selling "digital products" within the meaning of §§ 327 ff BGB due to lack of compatibility of the consumer's digital environment

I have received clear, understandable and comprehensive information about:
  • The technical requirements of the digital product for my existing digital environment. "Digital environment" includes both my existing hardware and software as well as network connections of all kinds.
  • The provision of necessary cooperation actions possible for me, which enable the seller to determine whether the defect or fault complained of by me is due to the fact that my digital environment was or was not compatible with the technical requirements of the digital product at the relevant time.
  • The obligation to provide such cooperation actions on my part exists only in the event that the seller wishes to use a technical means for determination that represents the least intrusion for me.

Exclusion of Update Obligation

Exclusion of the statutory update obligation when selling "goods with digital elements" or "digital products"

When selling "goods with digital elements" (e.g. vehicles equipped with driver assistance systems that are required for the vehicle's function) or "digital products" (e.g. vehicles or spare parts containing or connected to digital content or digital services that are not required for the function of the vehicle or spare part), the legislator has imposed an obligation on the seller to provide consumers with the "necessary" updates after the conclusion of the contract. However, the legislator has opened up the possibility for the contracting parties to make deviating agreements on this.

The seller will therefore only sell the purchased item to me in the event of an agreement to exclude the statutory update obligation.
