When selling "goods with digital elements" (e.g. vehicles equipped with driver assistance systems that are required for the vehicle's function) or "digital products" (e.g. vehicles or spare parts containing or connected to digital content or digital services that are not required for the function of the vehicle or spare part), the legislator has imposed an obligation on the seller to provide consumers with the "necessary" updates after the conclusion of the contract. However, the legislator has opened up the possibility for the contracting parties to make deviating agreements on this.
The seller will therefore only sell the purchased item to me in the event of an agreement to exclude the statutory update obligation.
